Following the hearing, the Hon'ble High Court was pleased to issue a Rule Nisi in following terms "...calling upon the respondents [in this case the relevant ministries of the Government of Bangladesh] to show cause as to why the Inaction on the part of the respondents to take any or any effective step or steps to ban all types of E-Cigarettes including Electronic Nicotine Delivery Systems (ENDS), Electronic Non-Nicotine Delivery Systems (ENNDS), Heated Tobacco Products (HTP) and their components or parts (e-cigarettes, vape vaping, dappers and e-liquids, etc.) altogether despite there is an unequivocal opinion that such products are injurious to human life and health thus violative to article 18(1) and 32 of the Constitution of the Peoples Republic of Bangladesh should not be declared has been done without lawful authority as is of no legal effect and why a direction should not be given to the respondents to take necessary steps to remove all types of E-Cigarettes including Electronic Nicotine Delivery Systems (ENDS), Electronic Non-Nicotine Delivery Systems (ENNDS), Heated Tobacco Products (HTP) and their components or parts (e-cigarettes, vape vaping, dappers and e-liquids, etc.) altogether from both online and physical market" The World Health Organization considers e-cigarettes to be a product that poses a risk to public health
